Acceptance of the Terms and Conditions
By registering or using LingoGalaxy’s services, you agree to accept the terms and conditions which govern access and your use of the LingoGalaxy.com website, as listed below. The terms and conditions constitute a legal arrangement between you, as a user of our services, and LingoGalaxy for the services that are offered through the website. Users of the LingoGalaxy website are expected to conform to the listed terms and conditions in all circumstances.

Acceptance of the Terms
By using the information, features, functionality, or tools located at the LingoGalaxy website (with or without the LingoGalaxy “service” or “services”), you agree to conform to this Arrangement and the Terms, regardless of being either a “visitor” (meaning you merely browse the LingoGalaxy website) or a “customer” (meaning you have registered with LingoGalaxy). The term “you” or “user” refers to a visitor or a customer. The term “we” refers to LingoGalaxy. The term “material” relates to all class material used in our classes. If you wish to become a customer, you could communicate your wish with other customers and/or make use of our service/services. However, you have to read LingoGalaxy terms and conditions and indicate your acceptance during the registration process. If you do not agree with all the terms and conditions, do not use the LingoGalaxy website and/or services. Please review all the terms and conditions thoroughly before using the LingoGalaxy website and or/services.

General User Responsibilities
All registered users agree not to post, distribute, publish or by any other means convey offensive material, including discourteous language, photographic material, or any other kind of material of an offensive or sexual nature. Violation of this agreement conditions by any user will result in termination of that user’s registration and will result in notifying the authorities and possibly taking legal action. All registered users agree not to post, distribute, publish, or by any other means place any computer code on the LingoGalaxy website, which directly or indirectly links to another Site without our express consent. All registered users agree not to distribute or share their username and /or password details with any other individual or company to provide other individuals permission to utilize the services provided through the LingoGalaxy website. All registered users self-certify that they can form legally binding contracts under the applicable regime of their country of residence.

Access and Interference
With your registration at the LingoGalaxy website you agree that you will not: Use any robot, spider, scraper, deep link, or other similar automated data gathering or extraction tools, programs, algorithms, or methods to get access to, acquire, copy or monitor lingogalaxy.com or any part of LingoGalaxy.com, without LingoGalaxy’ express written consent, which will be withheld in LingoGalaxy’ sole discretion; Use or attempt to use any engine, software, tool, agent, or other device or mechanism (including without limitation browsers, spiders, robots, avatars, or intelligent agents) to navigate or search the LingoGalaxy website other than the search engines and search agents available through the service and other than generally available third-party web browsers (such as Microsoft Explorer); Post or transmit any file containing viruses, worms, Trojan horses, or any other contaminating or malicious software/features, or whatever might interfere with the proper functioning of LingoGalaxy.com and/or its services; Attempt to decipher, decompile, disassemble, or reverse-engineer any of the software incorporating or in any way constituting a part of lingogalaxy.com and/or its services.

Student Registration
When registering as a student at LingoGalaxy, you will be required to provide personal information not limited to your preferred username and password; your email address; the language of your choice; your country of residence; your local currency, and your local time zone. By registering an account at lingogalaxy.com, you automatically confirm that you accept the terms and conditions of use. To use the LingoGalaxy platform, you will also be required to set up a Skype account and notify LingoGalaxy’s administration team regarding your Skype username that you will use for the language lessons, for our team to forward this information to your chosen language tutor.

Payment Obligations and Fee Distribution
Upon making a payment to the LingoGalaxy platform (accessible at lingogalaxy.com), the student is required to pay the remaining balance (the total cost of the study package minus the platform's fee) directly to the assigned instructor. LingoGalaxy will issue a receipt solely for the amount paid to the platform. The remaining balance paid to the instructor constitutes the instructor’s fee, for which LingoGalaxy assumes no responsibility in issuing a receipt.

Prohibited Conduct
Any attempt to circumvent the payment process established by LingoGalaxy, including but not limited to arranging lessons outside the LingoGalaxy platform or evading payment, is strictly prohibited. Such actions will result in the immediate termination of the student's account, and legal action may be pursued to recover any outstanding amounts owed.

Fee Modifications and Pricing
LingoGalaxy reserves the right to modify or amend its fees at any time without prior notice. All prices publicly displayed on lingogalaxy.com, including those for package renewals, are inclusive of all applicable fees.

Package Use and Restrictions
Each student is required to purchase their own lesson package. The lessons included in a package are non-transferable and cannot be shared among multiple students.

Refund Policy

Refunds may be granted within two weeks (14 days) from the date of purchase. After this period, no refunds will be issued. By purchasing a lesson package through the LingoGalaxy platform, the customer expressly acknowledges and agrees to this refund policy.

Instructor Availability and Lesson Continuity
In the event that an assigned instructor is unable to deliver the lessons for which the customer has paid, LingoGalaxy may, at its discretion, assign a replacement instructor at no additional cost to the customer. In certain instances, a replacement instructor may not be available. Should the customer choose not to continue their lessons with the replacement instructor, no refunds will be granted for any remaining lessons. By purchasing a lesson package, the customer expressly acknowledges and agrees to these terms.

Students – Fees and Cancellation Policy
You will be required to register and create an account with LingoGalaxy (the “Account”) to have access to the website’s services. Information gathered through the registration process and information related to your account will be subject to these terms as well as to our “Privacy and Security Policy.” You warrant that the information provided for the creation of a student’s account is truthful, accurate, and complete and that this information will stay truthful, accurate, and complete as long as you are registered at LingoGalaxy’s website. Certain materials and functionalities of the website are available only after the purchase of an online language package (the “Package”). According to this Agreement, you are responsible for any charges associated with registering on the website. LingoGalaxy reserves the right to change the price of the actual package fees or institute new fees at any time, upon reasonable notice posted on the website and emailed to current customers.

By purchasing a Study Package, you agree to be bound to the following terms:
LingoGalaxy ensures that every credit card/PayPal transaction you make at LingoGalaxy is 100% secure. If you wish to check on the status of your subscription, please log in and visit the “My Account” page in your Login area. All language course fees are recurring and non-refundable after your purchase. If you do not wish to continue studying at LingoGalaxy, you have to deactivate your account at the “My Account” page in your login area or provide us with a written (email) notice. LingoGalaxy is obliged to issue the student’s receipt only for the amount provided to the platform (lingogalaxy.com). The remaining amount, provided by the student/parent to the teacher, is the Language Tutor’s fee, and there is no involvement. Lesson packages booked and not used within five months will be canceled. Thus, if those remaining hours have not been used within five months after the date a student/parent purchased a class package, those unused sessions are lost and will not be refunded. 

Lesson Cancellation and No-Show Policy

A scheduled lesson must be canceled at least 48 hours prior to the appointed time. Failure to do so will result in the lesson being deducted from the purchased lesson package without further notice or the possibility of a refund. Additionally, if the student fails to enter the meeting room within 15 minutes of the lesson's scheduled start time, the lesson will be considered "completed" and deducted from the lesson package without further notice.

Free Trial
The free trial is available only to first-time users of the LingoGalaxy website.

Video Recording Policy
Sessions between language tutors and students will be recorded to ensure the quality and safety of the language courses. Parents will be asked to formally agree to the recording term by clicking on the corresponding box before registering themselves and their child/children at the LingoGalaxy platform. If a registered student/parent does not agree to comply with this term, he/she is advised not to click on that box. The video recording will remain on the LingoGalaxy website for three months. By the end of this period, the only ones who are permitted to have access to the video material are the parents and language students that are registered at the LingoGalaxy website, as well as the LingoGalaxy language tutors and administrative team. As soon as the period of three months ends, the video recordings will be permanently deleted. No one except the aforementioned parties is permitted to have access to the video recording. No other use except for ensuring the quality of sessions and students’ safety by uploading the video recordings at the LingoGalaxy website is permitted without parents’ written permission. All registered users (both students and their parents) agree not to post, distribute, or publish the video recordings. Violation of this agreement conditions by any registered user will result in the termination of that user’s registration and will result in notifying the authorities and possibly taking legal action.

Indemnification
You agree to indemnify, defend, and do not cause any harm to the LingoGalaxy platform and its affiliates, partners, suppliers, and employees due to any liability, claims, costs, or damages arising from your use of the LingoGalaxy website and/or your breach of this Agreement, in accordance with the terms and conditions set out herein.

Teacher Registration
When registering as a language teacher you will be required to provide personal information not limited to your username, password, email address, your full name, your date of birth, native language, country and address of residence, your local time zone (if applicable) and how you were informed about lingogalaxy.com. You will also have to confirm that you accept the LingoGalaxy terms and conditions of use. To use the LingoGalaxy platform, you will also have to set up a new Gmail account as well as a new Skype, Zoom and Google Meet account -exclusively for your collaboration with LingoGalaxy-. Due to the creation of a tuition profile at lingogalaxy.com, you will also be requested to inform the LingoGalaxy administrative team about your username and password for the aforementioned accounts. Please note that regular reviews of all accounts will be conducted, without prior notice, to ensure the quality and safety of our services. For the duration of your membership at the LingoGalaxy website, you agree to be bound by the LingoGalaxy terms and conditions of use.

Language Teachers – Compliance with Booking Procedure
By accepting these terms and conditions, all registered language teachers agree not to contact any registered LingoGalaxy language student either directly or indirectly to arrange tuition time with that student through any mechanism other than the LingoGalaxy website. All registered language tutors agree not to engage in or promote any activity to arrange lessons with a language student outside the LingoGalaxy website. An activity of this nature is specifically prohibited under our terms and conditions of service and undermines the trust, security, and legitimacy of the LingoGalaxy marketplace.

Activity specifically not permitted includes:
Communication via email, Skype, Zoom or other means to schedule and arrange a lesson with a language student in a way that is intended to avoid the payment of the booking fee to the LingoGalaxy website. Failure of a registered language tutor to adhere to these terms and conditions and in particular any action whatsoever taken by a registered language teacher with the objective of privately arranging tuition time with a registered LingoGalaxy language student, avoiding providing the booking fee to the LingoGalaxy website, will result in the termination of the cooperation between the LingoGalaxy platform and the language teacher that committed this action, as well as excluding the particular language student from his/her rights to use the LingoGalaxy website again and/or legal action against that language tutor and/or the language student and/or his/her parent might be taken.

Language Teachers – Delivery of Language Training Services
All registered LingoGalaxy language teachers agree to provide high-quality language training services to any registered LingoGalaxy language student in a timely fashion. We reserve the right to change the required standard at any time.

Miscellaneous Terms and Conditions
If any portion of this Agreement is deemed unlawful, void, or unenforceable by any arbitrator or court of competent jurisdiction, this Agreement as a whole shall not be deemed unlawful, void, or unenforceable, but only that portion of this Agreement that is unlawful, void, or unenforceable shall be stricken from this Agreement. You agree that if LingoGalaxy does not exercise or enforce any legal right or remedy which is contained in the Agreement (or which LingoGalaxy has the benefit, according to any applicable law), this will not be taken to be a formal waiver of LingoGalaxy’s rights and that those rights or remedies will still be available to LingoGalaxy. All covenants, agreements, representations, and warranties made in this Agreement shall survive your acceptance of this Agreement and the termination of this Agreement. This Agreement represents the entire understanding and agreement between the recipient and LingoGalaxy and supersedes and replaces all oral or written agreements concerning the subject matter hereof.
